网络服务提供者的侵权责任

随着互联网产业在中国的不断发展进步，广大网络用户在享受到互联网所带来的便利的同时，也面临着许多由互联网所带来的巨大危害，即网络侵权行为。导致此类侵权行为发生的并不仅仅只是网络用户个人，也涉及到了互联网世界的基石及重要组成部分：网络服务提供者。本文将对于有关网络服务提供者的一些问题进行论述和分析。首先本文将网络服务提供者侵权责任的概念进行叙述。主要包括网络服务提供者的定义及学界对于网络服务提供者侵权责任的分类。其次本文对网络服务提供者侵权行为的过错认定进行分类分析，并对网络服务提供者侵权的归责原则进行分类阐述。最后简要介绍了网络服务提供者侵权责任几种常见的承担方式。

The Tort Liability of Network Service Providers
ABSTRACT: With the Internet industry in China's continuous development and progress, the majority of Internet users to enjoy the convenience of the Internet at the same time, also faced with many of the great harm caused by the Internet, that is, network infringement. The cause of such infringement is not just the individual users of the Internet, but also the cornerstone of the Internet world and an important part: network service providers. This article will discuss and analyze some of the issues related to network service providers. First of all, this paper describes the concept of tort liability for network service providers. It mainly includes the definition of network service provider and the classification of infringement liability of network service provider. Secondly, this paper classifies the fault identification of network service provider's infringement, and classifies the principle of liability for infringement of network service provider. Finally, this paper briefly introduces the network service providers tort liability several common ways to bear.
