论民事欺诈和刑事诈骗的区别

经济发展随之而来的经济犯罪行为屡见不鲜，而与经济生活密不可分的犯罪行为就是诈骗，但是刑事诈骗与民事欺诈都是用骗的手段获取他人财物，实质上没有太大区别，但是在实践中如果不能明确的区分，严重损害当事人的合法权益同时也不利于经济秩序的平稳运行。将从理论和实践两个方面结合罗某笑案件展开分析。理论方面主要是主观方面和客观方面，实践方面主要是研究非法占有的。通过两方面，必将有一个深刻的认识。
