网络环境下著作权合理使用制度研究

作为著作权法中最重要的内容之一，合理使用在现实生活中发挥着平衡著作权人、相邻权人、传播者与公众使用者切身利益的关键作用,但在互联网迅猛发展的时代背景下却暴露出了诸多“不适之症”，现有的制度体系在力所能及的范围之内无法有效应对当下纷繁复杂的网络环境。鉴于此，我们需要在网络环境下重新探究这一制度，在立足于社会生活的实际状况下提出建设性意见，首先应调整我国立法体系，其次应调整合理使用的范围，最后可以引入著作权集体管理制度，让著作权合理使用更好地适应网络环境，为顺应时代潮流做出相应地变革，满足时代发展的需要。

Research on the System of Rational Use of Copyright
in the Network Environment

Abstract: As one of the most important contents of copyright law, rational use plays a key role in balancing the vital interests of copyright owners, adjacent rights holders, communicators and public users in real life. However, under the background of the rapid development of the Internet, many "discomfort" have been exposed, and the existing institutional system is unable to cope effectively with the complicated network environment within the limits of its ability. In view of this, we need to re-explore this system in the network environment and put forward constructive suggestions based on the actual situation of social life. Firstly, we should adjust our legislative system, and secondly, we should adjust the scope of rational use. Finally, we can introduce the collective management system of copyright, so that the rational use of copyright can better adapt to the network environment, make corresponding changes to conform to the trend of the times, and meet the needs of the development of the times.
