专利联盟的反垄断问题研究
摘 要
随着知识经济时代的到来，各国之间的竞争日益表现为知识和技术的竞争。由于技术发展的日新月异和专利权的广泛散布，专利联盟已经越来越成为国际间竞争的一种常态。近年来，以专利联盟和标准化为主题的热点频出，其中人们最为熟悉的就是DVD收费事件。伴随着现代战略管理理念的兴起，企业的核心竞争力的重要性已在理论界及实务界形成共识。目前国外企业在运用专利战略参与市场竞争时，其实施主体已逐渐由单个企业发展成为专利联盟的形式。不断有国际专利联盟对我国企业进行打压，严重抑制了我国相关行业的发展，迫使我国企业要强化对专利联盟的认识。然而，目前有关专利联盟的研究仍比较有限，这与现实中专利联盟愈来愈重要的角色相比，形成了较大的反差。虽然专利联盟在解决专利互补性问题、减少交易成本、防止侵权纠纷方面有着独特而重要的作用，但其作为“合作竞争”的一种方式，也极易危害自由、公平的竞争秩序，损害公共利益，从而走进反垄断法的调整范围。由于涉嫌专利权滥用问题，专利联盟成为了各国反垄断机构反垄断审查的重点对象。借鉴各国专利联盟反垄断规制经验，对于积极应对DVD、3C等专利联盟在我国高科技产业的竞争，推动我国知识产权领域反垄断研究具有十分重要的意义。

Abstract
As the era of knowledge and economy is coming, the competition among countries gradually represented by knowledge and technology competition..Due to the rapid technological development and widespread dissemination of patent, patent pool has increasingly become the normality in international competition.In recent years,the hot point of patent pool and standardization frequently turn up,among them that people are most familiar with is the event of DVD charges.With the rise of modern strategic concept of management, the significance of enterprises’ core competitive ability has reached a consensus in the field of theory and practice.Nowadays Foreign companies participate in the market competition by the use of the patent strategy , the implement subject has been gradually developed into the form of patent pool from the form of single enterprise. International patent pool is always put pressure on Chinese enterprises, greatly inhibited the development of related industry in China, forcing Chinese enterprises strengthen the knowledge of the patent pool. However, the current research of the patent pool is still limited, which is a great contrast to an increasingly important role of the patent pool in reality. Although the patent pool has an unique and important function in the solution of complementary patent,reducing the cost of trasaction and prevention of infregement dispute, it regarded as a means of "cooperative competition" is also easily harm the free and fair competition order and the public interest.Thereby the patent pool will enter the adjustment range of anti-monopoly law .For the suspicion of abuse of patent rights,patent pool became the focus of the national anti-monopoly mechanism.Learning the experience of other nation’s Antitrust Regulation about patent pool, is a positive push of the response for DVD, 3C and other high-tech industry patent pool competition in China, meanwhile it has a great significance in the promotion of the China's Anti-monopoly research in the field of intellectual property.
