关于私人侦探取证的几个问题的思考
摘  要：最近几年，私人侦探业在我国迅速发展。私人侦探取证成为学术界关注的问题：私人侦探取证是否侵犯公民隐私权？私人侦探取证是否侵犯国家侦查权？私人侦探取得的材料是否具有证据价值？通过对这些问题的思考与分析，以期通过法律实现对私人侦探的社会控制。

Thoughts On The Problem Caused By The Private Investigation

Abstract: The business of private investigators have an great develop very fast in recent years in China. And the academic members become focus on the problem that wether the PI had violated people's right to privacy and the right of investigation when they working,and did their evidence valuable ?To consider and analysis these problem ,we can effect the scosial control of the private investingation.

1992年，上海成立了新中国第一家私人侦探机构“上海社会安全咨询调查事务所”。但很快遭到公安部行政规章的明确禁止，1993年9月7日，公安部颁布的《关于禁止开设“私人侦探所”性质的民间机构的通知》中称：“鉴于这些民间机构的营业范围、权利义务等均无法律依据，所经营的各类业务已有公安机关、检察院、法院和司法部门分工管理，在经营活动中使用了一些手段违反了《中华人民共和国刑事诉讼法》的有关规定，行使了同国家执法部门的部门权力，已经产生了一些问题。
