试论听证制度在公安行政执法中的理论建构
摘 要
2005年8月28日，第十届全国人大常委会第十七次会议通过了《中华人民共和国治安管理处罚法》，这部法律已于2006年3月1日起施行。《治安管理处罚法》作为治安管理方面的基本法律，是维护社会治安秩序的重要依据，对于维护社会治安秩序，保护公民、法人和其他组织的合法权益，规范和保障公安机关及人民警察依法履行治安管理职责，具有十分重要的意义。本文通过对《治安管理处罚法》中听证制度的阐释，论述了公安机关在行政执法中对听证制度的适用范围、提出条件及适用程序应作进一步的理论建构，从而对实际工作中依法执法以期有所帮助。

Abstract
