论我国事实婚姻现状与对策
摘   要

事实婚姻是指没有配偶的男女，未依法履行婚姻家庭法的规定办理结婚登记，即以夫妻名义公开同居生活，群众也认为是夫妻关系的两性结合。我国在立法上一直采取婚姻登记制度，但由于受传统习俗根深蒂固的影响，男女双方未进行结婚登记而以夫妻名义同居生活的事实婚姻现象，在我国现实生活中普遍存在屡禁不止。对事实婚姻如何认定其法律性质，是否予以保护，在多大程度上给予保护一直是困扰司法实践的一个难题，受到了从业人员和立法者的高度关注。本文根据我国事实婚姻现实情况、中外关于事实婚姻的态度和发展趋势，结合实际就如何从法律上对事实婚姻进行保护谈谈自己的一些看法。

Abstract
Marriage is not the fact that spouses of men and women, in accordance with the law did not fulfill the requirements of marriage and family law for marriage registration, that is to open on behalf of cohabiting couples living, the husband-wife relationship is also the view that gender integration. China's legislature has been taken in marriage registration system, but due to the deep-rooted traditional practices affecting both men and women did not conduct marriage registration and the name of husband and wife living life to the fact that marriage is, in my real life, though widespread. The fact that his marriage to a legal nature, whether to protect, the extent to which protection has been plagued judicial practice is a problem, employees and legislators were concerned about the height. Based on the actual situation of China's de facto marriage, foreign marriage on the fact that the attitude and trend of development, in light of the realities on the legal protection of marriage to talk about the fact some of their own views.
