关于我国私人侦探介入刑事侦查的法律思考
摘要：随着我国私人侦探业的发展，私人侦探业务范围逐渐由单纯的涉及民商领域向刑事诉讼领域延伸，尤其表现在刑事侦查阶段。通过对私人侦探在我国的现状和理论界的争议以及介入刑事侦查的价值、可行性、必要性分析，私人侦探的介入可以弥补我国司法资源的不足，可以克服我国《事诉讼法》制度上的缺陷。私人侦探应该介入刑事侦查，对于介入的消极影响，应通过制度的完善，明确
防御性以刑事调查的方式介入，对调查取证的手段和使用工具进行规范，对私人侦探的法律责任及其获得的证据的证明力的规定，加强对私人侦探行业的管理等来消除。使着私人侦探延着规范、有序的方向发展。

   Abstract: With the development of the private detective, Private detective business gradually involved in criminal procedure from a simple civil and commercial fields, particularly stage in the criminal investigation。by analyze private detective in the current situation of China and argumentation in theory area and the value of the criminal investigation, feasibility, necessity on the involvement in Criminal Investigation.the involvement of the private detective can make up for the shortcomings of our judicial resources, can be overcome the defects in a system of "Criminal Procedure Law,"private detective should be involved in the criminal investigation.We should eliminate the negative effects of intervention by the improvement of System Improvement, Clearly defensive manner in order to intervene in criminal investigation, Means of investigation and evidence collection and use of tools to regulate the provisions of the legal responsibilities of private detectives and evidence obtained by force.to make a normative, orderly development of . private detectives.
