劳务派遣中和谐劳动关系建立的对策研究

在十一届全国人大二次会议上,国务院总理温家宝作政府工作报告时表示,要千方百计促进就业。在就业压力较大的今天,劳务派遣有其存在的需要和空间,因其具有人事成本低、用人机动灵活、雇佣和管理弹性化、选择工作的自由度高、帮助弱势群体就业、实现人力资源共享等特点,对涉及三方均有益处而显示出强大的生命力。《劳动合同法》的出台,对劳务派遣做了特别规定,一定程度上规范了劳务派遣行业。但现实中,劳务派遣有扩大化、主流化的趋势,在立法上与实践中仍存在许多不完善之处,被派遣劳动者的合法权益未能得到全面有效的保护。因此,本文通过对劳务派遣法律内涵、实质的描述,分析其应用价值,对新法实施后劳务派遣的立法与实践问题进行研究,提出相应对策以促进劳动关系和谐稳定发展。

Abstract
In the Second Session of the Eleventh National People's Congress, Premier Wen Jiabao made the government work report. He said, it is necessary to take measures to promote employment as far as possible. Dispatch services has its development space because of low cost, flexibility high-degree of freedom to choose a job. It helps disadvantaged groups to get a job, promote human resources sharing and shows great vitality in benefits involving the tripartite consultation. The introduction of labor standardize the dispatch services industry to some extent. But in reality, there is expansion of the dispatch services, the trend of mainstreaming and there are still many shortcoming. Furthermore, laborer's rights and benefits can not be fully effective protected. Therefore, this article analysis value of dispatch services in terms of the descriptionon the legal and try to discover appropriate measures to promote the healthy development of harmonious relations.
