有关农村宅基地使用权流转的法律思考


摘要: 在农村房屋买卖领域,出现购买主体由以前的集体经济组织内部成员扩大到外村村民甚至城镇居民的新变化。解决这一变化引发的新问题,已成为当务之急。但是我国农村宅基地使用权法律制度存在很多缺陷,其立法基础和标准不统一,又导致现行相关法律规定相互矛盾。我国应确立完善的农村宅基地使用权登记制度,逐步实行有期限、有偿使用农村宅基地,在条件成熟时以立法形式规范农村宅基地使用权的流转。

Abstract: :In the countryside house business domain, a prominent change is the buyer expand from beforehand collective economy organization interior member to the outside village villagers even cities in-habitant. How solves this change initiation new problem, has become the urgent matter.But the system of the right to use the rural residential bases in china has many deficiencies, the basis of its legislation and standards are not unified, has led to the current relevant laws and regulations contradict each other. China should establish a sound rural house right to use registration system, and gradually implement a period of paid use of the rural house, and when conditions are ripe, so as to the form of legislation regulating the rural house, the transfer of the right to use.
