论我国人事争议仲裁制度的改善


摘要
人事争议仲裁制度是我国仲裁司法体系的重要组成部分。本文通过简述该制度当前的基本情况,分析了人事争议仲裁的特点及意义,对人事争议仲裁的范围进行了阐释,分析了其变化演进的过程,对于人事争议仲裁的仲裁机构的性质地位和作用进行了说明,总结了人事争议仲裁适用的法律法规。而后从部门规章与司法解释相龃龉,人事争议仲裁的争议主体、争议事项范围狭窄且不确定,仲裁机构缺乏中立性且其组成人员资质不足,人事争议仲裁与司法救济衔接不畅通等四个方面分析了当前人事争议仲裁制度存在的主要问题。并且从内部到外部、从微观到宏观地提出了具体扩大人事争议仲裁受案范围、确立行政裁决制度、设立独立的劳动人事仲裁院、畅通司法救济渠道等方面的措施,并对完善人事争议纠纷解决的实体和程序立法提出了相关的建议以消除前述弊端,完善我国人事争议仲裁制度。

The Improvement of Personnel Dispute Arbitration System in China
 
Abstract
Personnel dispute arbitration system is an important part of the judicial system. This paper briefly present the basic situation of the system, analyzes the characteristics and the significance of the personnel dispute arbitration. The scope of personnel dispute arbitration was explained, while the changes in the process of revolution were analyzed. The status and the nature of the authority of personnel dispute arbitration was illustrated. The laws and regulations applied to personnel dispute arbitration were summed up as well. Then the flaws of personnel dispute arbitration was pointed out, such as the mismatch of departmental rules and judicial codes, the stricture and uncertainness of the extension, the lack of neutral arbitration organizations and ill-qualifications of its members. And from internal to external, from the micro to the macro to put forward specific case by expanding the scope of the personnel dispute arbitration, to establish administrative adjudication system, establishment of an independent Court of Arbitration of labor and personnel, smooth channels of judicial relief and other measures, and improve the personnel dispute address substantive and procedural recommendations related to proposed legislation to eliminate the aforementioned drawbacks, and improve personnel dispute arbitration system in China.
