我国环境责任保险制度的构建研究

摘  要：随着我国工业化与城市化进程的推进，环境污染事故日益频繁，由环境污染导致的环境侵权救济方式问题也日显突出。环境污染已经成为制约我国经济社会发展的主要瓶颈。环境责任保险兼具了经济手段的弹性和行政手段的强制性，建立起符合实际情况的环境责任保险制度体系，对于我国解决环境污染问题，促进经济、社会、人类可持续发展都会有着重要的意义。本文就是在考察和分析国外环境污染责任保险制度实践与发展、我国环境污染责任保险现状及存在问题的基础上，对我国环境污染责任保险制度的完善提出了几点建议。

The research of Environmental Liability Insurance System in China

Abstract: As China's industrialization and urbanization process moves forward, increasing environmental pollution accidents, environmental pollution caused by the tort remedies environmental problems more evident. Environmental pollution has become China's economic and social development restricting the main bottleneck. Environmental liability insurance both flexibility and economic means of the compulsory administrative measures, and establish realistic situation of institutional system of environmental liability insurance, for the solution of environmental problems, promote the economic, social and sustainable human development will be of great significance . This is the environmental pollution in the study and analysis of foreign practice and the development of liability insurance, liability insurance situation and China's environmental pollution problems, based on China's environmental  pollution liability insurance system, improve some suggestions.
