在对小产权房困惑的背景下论城乡统一土地市场的构建

我国现行城乡割裂的土地市场制度结构,具有典型的二元特征,土地产权、土地使用权、土地价格等都存在严重的二元结构特征、城乡割裂。小产权房的出现引起了学术界激烈的讨论却难以得出一个统一的结论;而政府对其态度同样模糊、充满不确定性。本文透过这种现象,在一定程度上分析其出现的本质原因是城乡土地市场的不统一,构建统一的城乡土地市场将能促进统筹城乡和谐发展。
本文广泛地了解和借鉴前人对小产权房及统一城乡土地市场的相关研究成果,采用了文献分析方法和博弈论的分析视角,分析认为对土地属性的认知不清、土地规划使用不科学等均是造成小产权房以及诸多矛盾阻碍城乡统筹发展的重要因素,因此必须对城乡割裂的土地市场制度进行改革,建立健全城乡统一的土地市场制度是解决这些问题的核心和关键。

Abstract
China's current land market system is different in urban and rural area, and with typical binary feature. There exist serious dual structure in land ownership, land use rights, land prices and so on. The small property right room turn up to cause the academics have various opinions to it. This has causing a fierce debate and is hard to draw a unified conclusion. However, the government’s attitude towards it is vague, full of uncertainty. Through this phenomenon, to a certain extent, this paper analyzed the essential reason of it, and finds the disunity of urban-rural land market system is the key point. Therefore, to build a unified urban-rural land market system will promote the harmonious development of urban-rural area.
In the process of learning and researching to this paper, the relative research results of small property right room and unified urban-rural land market from predecessors have been widely learned and referred. Analysising that the unclear recognition of land property, the unscientific planning and use of land are also the main elements that cause the appearance of small property right room and many contradictions which impede the urban-rural area’s harmonious development. Thus, the disunity of urban-rural land market system should be reformed, and to build a perfect unified urban-rural land market system will be the core and key point to solve these problems.
