【内容摘要】

劳动者单方解除劳动合同研究 ——基于《劳动合同法》的规定


劳动合同是劳动者与用人单位确立劳动关系,明确双方权利义务的法律形式。劳动合同单方解除,即享有单方解除权的当事人通过单方意思表示来解除劳动合同,而不以他人的意志为转移。本文立足于《劳动合同法》中关于劳动者单方解除劳动合同的若干规定,从管理学、经济学和法学的视角分析其理论依据。同时,由于劳动者单方解除劳动合同的问题占劳资纠纷的比例较大,因而笔者以自身实习过程中的所见所闻来提出劳动者单方解除劳动合同在实践中出现的问题,并分析其产生的原因。最后,结合现有的理论成果,并借鉴国外(地区)的相关立法,在此基础上提出建议。

ABSTRACT
The labor contract is workers and employers to establish labor relations, the definition of the rights and obligations of the legal form. Unilaterally Terminate the labor contract means that the parties have unilateral right of termination, terminating the labor contract by the way of the unilateral intention and not to other people's will. This article is based on some provisions about unilaterally terminate labor contracts in "Labor Contract Law". Firstly, it discusses its theoretical basis by the view of management, economics and law. Secondly, because unilaterally terminate the labor contract make up a larger percentage in employment disputes, the author point out some problems and analysis their reasons which are based on the experience. Thirdly, with the help of the existing theoretical results and foreign countries or regions' legislation, the article made some corresponding proposals.
