论民事商业赔偿中的企业的不动产方面的资产评估


随着改革开放30年,我国经济得到了蓬勃的发展。越来越多的企业成立,并且得到发展。但是随着我国经济的发展,企业之间的民事纠纷也逐渐变多,我国民事纠纷的案件数量逐年呈递增趋势。但是我国的民事立法缓慢,完全跟不上经济发展的速度,所以在我国的民事赔偿案件中有许多的漏洞。
特别是在企业不动产(建筑物)的资产评估的司法实践中,企业不动产的估计标准使用的还是1982年的规定,已经很明显跟不上时代的脚步。而在现在的资产评估的行业中,不仅仅使用成本法,还会使用例如市场法、收益法等其他的评估方法。因此我将在这片文章中研究和讨论现行的几种不动产(主要为建筑物)的主要的估价方法,并对现行的司法实践中的不动产(主要为建筑物)的不足之处提出改进意见。

Abstract
With 30 years of reform and opening up, China's economy has boomed. More and more businesses set up and develop. But with China's economic development, civil disputes between enterprises have gradually become more, the number of cases of civil disputes showed an increasing trend year by year. However, China's civil legislation is slow, completely keep up with the pace of economic development, so the civil compensation cases in our country there are many loopholes.
Especially in the corporate real estate (buildings) of the judicial practice of asset valuation, corporate real estate estimated standard still using the 1982 regulations, is already evident in the footsteps behind the times. And in the current assessment of the assets in the industry, not just the cost method, also uses such as market approach, income approach and other assessment methods. So I will in this article and discuss several existing real property (mainly buildings) of the main valuation methods, and the current judicial practice real estate (mainly buildings) the inadequacy of suggestions for improvement .
