软件行业知识产权保护研究
摘要：知识经济时代，知识产权作为一个企业乃至国家提高核心竞争力的战略资源,凸现出前所未有的重要地位。软件是一种智力产品，由于其极易复制和传播，使得对其的侵权现象十分严重。盗版是软件侵权的主要形式之一，它给企业造成了巨大损失，极大地危害了软件行业的发展，这使得软件知识产权保护问题变得日益突出。本文从经济、法律和管理三个方面，立足软件知识产权保护的特点和国际软件知识产权保护趋势进行了系统分析。在经济方面，本文研究了软件行业市场运行机制和存在障碍因素，突出了相关建议和策略；在法律方面，本文研究了运用法律进行软件知识产权保护的一般问题，给出了企业运用法律武器保护软件知识产权的策略和建议；在管理方面，本文研究了软件行业特点和运行环境，分析了软件企业在软件知识产权保护中存在的问题，以及软件知识产权保护制度的构建。基于以上三个方面分析，提出构建“三位一体”的软件知识产权保护体系，提高软件行业在国民经济中的经济效益和社会效益。

Abstract：The era of knowledge economy, intellectual property rights as a core business and improve the competitiveness of the country's strategic resources, highlighted the important position of unprecedented. Software is a kind of intellectual products, because of its easy to reproduce and spread, making them a very serious problem of infringement. Software piracy is one of the main forms of infringement, it will give enterprises has caused tremendous losses, greatly endangering the development of the software industry, which makes software intellectual property protection has become increasingly prominent. This article from the economic, legal and management of the three aspects，based on the characteristics of software intellectual property protection software intellectual property protection and international trends in the analysis. On the economic front, this paper, the software industry market operation mechanism and the presence of obstacles, highlighted the recommendations and strategies in the legal aspects, the paper on the use of legal software intellectual property protection for the general problem, given the enterprises to use legal weapons to protect Software intellectual property strategies and recommendations in the management, this paper features of the software industry and operating environment, analysis of the software enterprises in the software intellectual property protection in the existing problems, and software intellectual property protection system in China. Based on the above three aspects of proposal of building a "trinity" of software intellectual property protection system and improve the software industry in the national economy in the economic and social benefits.
