论我国法官职业保障制度的完善

法官职业保障制度维持法治的重要制度。我国法官职业保障制度的现状是权力缺乏保障、身份缺乏保障、待遇过低、人身安全受到威胁，分析其原因是法官职业的广泛化、司法体制不独立、法官管理的行政化以及人大监督的扩大化，这也造成了司法不公、司法腐败等后果。通过分析法官职业制度缺乏保障的原因以及危害性，进而提出完善我国法官职业保障制度的措施，从权力、身份、收入、安全等方面进行完善。

The improvement of the System of Judge’s Professional Guarantee

Abstract: Judge’s professional guarantee system is an important system for maintaining the rule of law. The present situation of judge’s professional guarantee system is the absence of authority, weakness of identity, bad treatment, and punishment .The reason of the popularization of judges, the localization of legal system. The management for judges inclined to administration, and the expansion of supervision of people’s congress which result in some passive effects as unfair legal justice, serious corruption. Through analyzing a the general situation of judge’s professional guarantee system, this article demonstrates the reason and harm of lacking guarantee for judges in our country, and brings up the tentative idea to construct judge’s professional guarantee system in our country.
