【摘要】

电商法视角下的电商主体责任研究

互联网的虚拟性导致电子商务经营主体与现实经营主体之间的对应关系隐性化,交易主体责任难以追溯使网络市场监管面临挑战。根据2017年国家公布的《电子商务法》(草案),我国电子商务主体为电子商务经营者,包括电子商务平台经营者和电子商务非平台经营者。电子商务主体责任主要是对用户的责任、对消费者的责任。第三方平台承担主体责任时存在一些特殊规定,如:身份中立、恶意投诉下的、侵权预防措施、恶意投诉应对、平台交易快照的证据效力以及时间戳等。本文结合电子商务实践分析了当前我国电子商务经营中突出的问题,包括信息审核和公示问题、消费者权益保护问题以及知识产权问题。

On the Responsibility of E-Commerce Subject under the Perspective
of E-commerce Law

Abstract: The virtual nature of the Internet has led to the implicit relationship between the e-commerce business entity and the real business entity. The supervision of the e-commerce market faces enormous challenges. According to the “Electronic Commerce Law” (draft) announced by the state in 2017, the main body of e-commerce in China is e-commerce operators, including e-commerce platform operators and e-commerce non-platform operators. The main responsibility of e-commerce is mainly the responsibility of the user and the responsibility of the consumer. There are special provisions for the third party platform to bear the main responsibility, such as: identity neutrality, malicious complaints, infringement prevention measures, malicious complaints response, evidence of the effectiveness of the platform trading snapshot, and time stamp legal effects. This article combines the practice of e-commerce to analyze the outstanding issues in China's current e-commerce business, including information review and publicity issues, consumer rights protection issues, and intellectual property issues.
