中止犯的自动性研究
中止犯的自动性是中止犯理论中最复杂、最有争论价值的问题，它直接与刑法的基本观念相联系，不仅牵涉到刑法与刑罚基础理论，甚至涉及刑事政策、刑法哲学相关问题。本文立足于我国现有刑法理论对中止犯制度研究成果的基础上，借鉴大陆法系关于中止犯自动性问题的相关理论，将大陆法系刑法理论中关于自动性判断的传统观点（包括主观说、限定主观说、客观说）和我国权威学者张明楷教授提出的新近观点——逐步判断说进行比较研究，继而对我国司法实务中中止犯自动性的判断标准提出新的设想，希冀为我国司法实践提供合理而实用的自动性判断标准。

Abstract: The research of automaticity is the most complex and most valuable problem of the discontinuation of a crime, it is directly linked to the basic idea of criminal law, the basic theory not only involved in the criminal law and punishment, even criminal policy, criminal law philosophy. Based on China's existing criminal law theory of suspension system on the basis of research achievements made, draw lessons from the continental law system about suspend crime automaticity of related theory, the continental law system in criminal law theory of the traditional view of automaticity judgment (including subjective, limit the subjective and objective said) and the new point of view put forward by the authoritative scholar professor Zhang Mingkai -- judge said a comparative study step by step, and then suspend crime in the judicial practice of our country automaticity judgment standard put forward new ideas, hope for our country judicial practice provide reasonable and practical automaticity judgment standard.
