占有权利推定规则研究

摘要：从占有概念的提出到当今占有权利推定规则在外国及一些地区立法中的成熟，我国在2007年颁行的《物权法》中也把占有作为一编专门规定，为我国的占有制度奠下了基石，但是其整个一章只有5个条文，内容极其简陋，缺失了许多关于占有的重要制度，尤其是对于占有制度中最核心，最重要的占有效力问题，几乎没有做任何规定，使得占有一章的存在价值几乎荡然无存，其应有的立法作用也大打折扣。纵观各国以及一些地区对占有权利推定的立法，不难看出这一制度在现实生活中和法治生活中的重要意义。

Abstract: From concept to occupy occupies presumption in today's rules and some areas of foreign legislation in China in 2007, mature, the property of the possession of a special provisions in China, compiled for the possession of the foundation and its system, but the whole chapter 5, the content is very simple, lack a lot about the important system, especially the core system for possession of possession, the most important problem, almost without doing any provisions that occupies chapter almost disappeared, value the legislative action. In some areas and countries throughout the presumption of legislation, it is easy to see that a system in real life and the importance of the rule of life.
