畲族民俗文化法律保护存在的问题及对策
摘要：宁德畲族民俗文化内涵丰富，是调查、研究和借鉴畲族历史文化的主要依据。在人口流动及外来文化的冲击下，畲族民俗文化面临失传的危机，而现有的知识产权法和《文物保护法》等均无法满足对畲族民俗文化保护的要求。福建省应在现有立法的基础上，确立畲族民俗文化保护的原则,做好民俗文化的普查工作,建立传承者保护机制，采取合理的保护对策,制定以当地政府为主导、社会群众共同协作的保护机制。

Abstract: Ningde SHE folk culture has rich content, it’s the major basis of the investigation, study and draw lessons from the SHE’s history and culture. Existing intellectual property law and the " Conservation law" can’t meet the requirements of the protection of SHE folk culture. Fujian Province, should be the basis of existing legislation to establish the principle of the protection of folk culture, folk culture of the census to do a good job of work, the establishment of heritage protection mechanisms, to take reasonable protective measures, to play a local government-led, social role of the masses together.
