农村集体建设用地使用权市场化流转中收益分配机制的法治研究
 
摘要：随着社会经济的进一步发展，城市化建设更是使得农村集体建设用地的商品属性日益突出。农村集体建设用地使用权的市场化流转产生的收益分配问题的现有法律制度更是进一步伴随着人们权利、义务观念的增强而显得举步维艰。本文在分析农村集体建设用地市场化流转中的收益分配法律机制内涵、原则、内容、操作方式上等事实问题的基础上，结合相关资料的研究，提出应该明确收益分配机制的内涵、原则，进一步确定我们收益分配机制的内容，和法定化收益分配机制的操作规范，达到强化收益分配主体各方的法律意识，使强有力的法律措施，更直接有效的保障权利、义务的顺利实现。

Abstract：With the further development of the social economy, the merchandise property of the the land used for construction of rural  collective organizations has manifested itself in the process of urbanization. Some issues of revenue distribution are caused by the  marketing conversation of the rights to use rural collective constructional land, and the current legal system has difficulty in taking a step  since people's awareness of  right and duty has been improved steadily. By analyzing the research on related  materials and the issues  which contain the nature, principles, contents and operating methods of the legal system , the author points out the necessity of making  its nature, principles and contents clear. The author also develops the idea that legalization in operating norms of revenue distribution  system should be on the agenda for the purpose of strenthening the legal consciousness of its subjects, thus the realization of people's  rights and duties can be ensured by the forceful legal measures.
