论离婚扶养制度的缺陷及完善
摘要：通过对我国离婚扶养制度的实施现状及存在的问题进行分析，从因现行法律未将离婚扶养制度与个人实际情况相结合等几个方面阐述了我国离婚扶养制度方面出现的问题，引起一部分人离婚后生活困难需要政府的救济，给政府财政带来压力，导致社会的一些不稳定因素产生的原因。以及提出完善我国离婚扶养制度的必要性，进而提出了完善离婚扶养制度的建议：具体明确的规定离婚扶养费请求权人、义务方的条件及限制条件；离婚抚养费给付数额和方式以及给付义务的履行和保障制度等。
