网络环境中虚拟财产问题研究
【摘要】互联网的出现促进了人类社会的信息交流，在人类原有的公共活动范围之外缔造了一个虚拟的公共空间，尤其在网络游戏兴起之后，网络的娱乐迅速占领了年轻一代人的生活空间，成为生活的一部分。由于虚拟财产不同于传统财产，而没有得到虚拟财产在现行法律中尚未得到合理的承认与保护。本文在分析各家言论的基础上，把虚拟财产纳入财产的范畴，并且通过探讨其法律属性和特点，分析虚拟财产的交易及交易所产生的纠纷来尝试构建保护体系。

【Abstract】The appearance of internet has greatly promoted information communication among human being, and created a new virtual public living space beside the already existing living space. Amusements on the internet become a part of life to young people, especial after the rising of cyber games. Because virtual property is different from traditional property, it hasn’t yet obtained the rational and protect in the current laws. Based on the analysis of various statements, this text think the virtual property should be belonged to property. And based on the analysis of legal character and characteristics, the transactions and the disputes arising from the transactions, the author tried to build up the protection system of virtual property.
