工程招投标中有效防范缔约过失的研究

摘　要

自推行工程招投标制度以来，工程建设领域各主体的行为得以进一步规范。如今，工程招投标已成为工程承发包的主要形式。受市场经济环境复杂多变等因素的影响，工程招投标过程中依然存在着一些令人堪忧需亟待解决的问题，由于招投标双方违背诚实信用原则而造成缔约过失的现象也屡见不鲜。缔约过失责任是指缔约人在缔约过程中因违背诚实信用原则造成缔约相对人利益损害而依法需要承担的责任。工程招投标活动中缔约过失行为产生原因复杂，表现形式多样，加之工程招投标本身多涉及法律与合同等方面的诸多问题，如何有效防范缔约过失，始终是规范招投标活动中各方行为的热门话题。在当今工程建设领域，只有首先分辨出缔约过失在工程招投标过程中的表现形式，然后正确划分招投标中缔约过失责任，才能维护工程招投标的严肃性，才能真正维护缔约双方的合法权益，确保工程招投标的健康发展。我们有理由相信随着与工程招投标相配套的相关法律法规日臻健全完善，工程招投标市场必将日渐规范。

Abstract

 Since the implementation of project bidding system, engineering construction field the main body behavior to further standardize the. Now, project bidding has become the main form of project contract. Under market economy environment complex changeable factors, project bidding process still exist some worrying need urgently to be solved, because the bidding parties violates the principle of good faith and due to contracting fault phenomenon and it is often seen. The contracting fault liability refers to the parties in the contracting process because of violates the principle of good faith by contracting the relative interests damage and legal responsibilities. Project bidding activity contracting negligence causes complex, diverse manifestations, in project tendering itself involve legal and contractual problems, how to effectively prevent the contracting fault, always is the norm in the bidding activities conduct hot topic. In the field of engineering construction, only the first to distinguish fault in project bidding process in the form of expression, and then differentiate correctly bidding contracting fault liability, in order to maintain project bidding seriously, can truly protect the legitimate rights and interests of parties, to ensure the healthy development of Engineering bidding. We have reasons to believe that along with the project bidding matching related laws and regulations and perfect, project bidding market will be increasingly standardized.
