浅谈亲亲相隐制度

摘    要

亲亲相隐是我国传统法律文化中的一项重要的,具有代表性的制度，他影响了中国两千多年的立法。这一制度发端于春秋，确立于汉代，此后经历了唐、宋、明、清、民国时期，在此期间得到了不断的完善，对我国古代历史发展产生了深远的影响。研究我国古代亲亲相隐制度的发展历程，通过对这一制度发展规律和特点的分析，我们由此得出，彻底的否认和废除亲亲相隐制度并不科学，禁止这种制度产生的危害也在司法实践中日见端倪。因此，我们有必要注意到亲亲相隐制度对历史的消极影响和积极影响，借鉴对这一制度对历史的影响，有助于我国现代法制建设。笔者欲从亲亲相隐制度的概述，我国亲亲相隐制度的发展历程及其规律特点，亲亲相隐制度的历史影响这三个方面出发，浅谈亲亲相隐制度。

Abstract

Relatives of traditional Chinese legal culture is an important and representative system, and he would affect more than two thousand years of China’s legislation. This system began in the Chunqiu, established in the Han Dynasty, after going through the Tang, Song, Ming and Qing, the Republic of China during the period has been continuously improved, the development of China’s ancient history have had a profound impact. Study of ancient China with implicit system relatives the development process of the system through the development of the rules and characteristics of the analysis, we thus conclude that the abolition of complete denial and does not kiss with implicit system of science, resulting from the prohibition of such a system hazards are increasing signs of judicial practice. Relatives-phase system will be implicit in our legal system, the reconstruction of the kinship relations between people, relations of trust than ever before, it is urgent and necessary. I want to kiss with implicit system form an overview of China’s relatives implicit system and the law of the development process of the characteristics of hidden relation in the history of the impact of these three areas, the relatives of a system of implicit.
