道德和法律的关系

摘要
道德与法律的关系这个命题，一直是大家讨论的热点话题之一，说法很多。现代性社会的两大规范体系-法律和道德在不时的冲突和融合。这种矛盾着的社会现象所产生的巨大后果是进一步加深了人们的迷惑以至于无法消除迷惑。即使是诸多的学者无论是前时的还是当下的，在诸如社会学、法学、哲学、政治学、伦理学以及经济学等上诠释着这一普遍而深奥的问题，并建立起各自的理论体系。虽有所共识，但仍旧无法达成和谐的一致。依然站在各自的领域内无休止的“争吵”着，谁也无法统合人们的认识。人类思维方式的不合一致及矛盾本身具有多角度思考的特性，决定着争论是必然的。这也昭示着法律和道德这一永久以来的矛盾体将是人类探讨社会和谐与自然和谐的永恒主题。本文拟结合中国传统法文化和马克思主义中道德、法律的观点，谈谈自己的一些看法。

Abstract

This also shows that the legal and ethical conflicts since permanent body to investigate the social harmony of human nature in harmony with the eternal theme. This paper intends to combine the traditional Chinese method of Marxism in cultural and moral, a legal point of view, to talk about some of the views of their own.
