中美律师职业准入制度的比较研究

摘要：
法律职业准入制度是指法律职业从业人员从业资格制度，通常也就是指相关人员必须经过法律知识和职业伦理水平的统一考试才能获得从业资格的制度。本文旨在通过观察美国的法律职业准入制度，对其制度现状做一些初步的研究，并通过与我国的现状做一定的比较，以发现探究我们的不足之处，借鉴其较为先进、科学之做法。文章主要介绍了美国的律师职业准入制度，以及对中国当前的准入制度做了简单的关注，通过对两个国家的这一制度进行较为全面的比较，逐步展开，以发现我国当前在这一制度方面所存在的不足之处，并提出了一些建设性的建议。以使我们的这一制度更加的完善，使我们的法律职业准入有更为科学、严格、统一的标准，从而使我们的法律职业群体的整体素质更高，能够更好的为社会主义法制建设发挥出应有的作用。

Abstract
Access system for the legal profession means that employees in the legal profession qualification system, usually refers to the relevant staff must be of legal knowledge and professional ethics in order to test the level of the unified system of access to qualified practitioners. The purpose of this paper by observing the United States access to the system of the legal profession, the status of their system to do some preliminary research and with the status quo of our country to do some comparison, to find into our shortcomings, and draw on its more advanced science practices. The article mainly introduces the U.S. legal profession access system, as well as access to China's current system has done a simple concern about the two countries through the system more comprehensive comparison, and gradually begin to discover our country in this by the existence of a system inadequacies, and put forward some constructive suggestions. To make our more perfect this system so that our legal profession have access to more scientific, strict and uniform standards so that our legal profession, the overall quality of higher groups can be better for the socialist legal system the construction of a proper role to play.
