论数字作品的版权保护

摘要

在现今社会信息化当道，数字技术的不断发展并不断渗透到人类各个领域，不少传统作品都纷纷以数字化形式出现。数字作品如今作为人们娱乐生活重要调剂，在数字技术的带动下快速的发展起来。但在其发展的同时，它所带来的问题也越来越明显。数字技术的出现使数字作品的版权保护受到巨大的威胁，给著作权的保护带来了很多新的阻碍，对我国关于著作权的法律体系造成了巨大的冲击，使得原有的版权保护的法律体系与如今的一些新技术产生了新问题。本文从数字作品的版权出发，从国内、国际立法及对其保护的思考角度进行了比较分析，并结合国内国际的现实情况着重阐明数字网络环境下对数字作品版权的保护问题，探讨我国当前对数字作品保护存在的不足及其原因以及对我国的数字作品版权保护提出了建议。

Abstract

Nowadays, with the digital technology development and pervasion to the every field in people′s life, more and more works becomes digital.The digital works becomes Important to adjust people's entertainment life,under the leads of the digital technology to development.But at the same time in its development,it brings the problems more and more obvious. The digital technology’s appearance causes the copyright protection of digital works to receive the huge threat, brought a lot of new obstacles to the copyright protection, caused a huge impact on the legal system of China on copyright, made the legal system original of copyright protection and some new technology has a new problem. The copyright of digital works, a comparative analysis from the perspective of the protection of domestic and international legislation and its thinking, combined with the reality of domestic and international focus to clarify the problem of digital copyright protection in the digital network environment, explore when Chinashortcomings and the reasons for the protection of digital works, and made recommendations on China's copyright protection of digital works.
