《九命奇冤》的讼师形象及其功能

摘要
讼师，是中国传统法文化中不可忽视的现象。在很多文本的刻画下往往全被描写成混淆是非的讼棍。本文首先分析清朝时期文化思想和制度与讼师之间的联系，清朝时期是排斥讼师的，讼师本身就是不合法的。加上有些讼师的却混淆是非、颠倒黑白，所以讼师的形象极其不好，社会地位低下，担任讼师的人是一些落第的秀才、师爷等。再通过研究《九命奇冤》一书中所描写的讼师的形象及其功能，将其中描写的讼师的形象和功能进行概括和分类，施智伯、东莱和尚这类正义公平的讼师与区爵兴、凌宗孔这类讼棍进行分类，还原我国讼师本身的真实形象和功能。

LITIGATOR Image and Its Function of Nine Murders
Abstract
LITIGATOR phenomenon can not be ignored in the traditional method of Chinese culture. Often portrayed by a lot of text have all been described as the shyster confuse right and wrong. This paper first analyzes the link between the Qing Dynasty cultural ideology and system and Lawyers understand the origin and status with lawyers, and was caused by LITIGATOR low social status factors summarized. By studying the "nine lives Vengeance," a book with lawyers depicted the image of their functions, with lawyers which told the story of the image and functions of an overview and classification, to restore our country LITIGATOR image and function
