农村"留守儿童"犯罪问题研究

摘要

当前，随着我国城市化，市场化和工业化的迅猛进程，越来越多的农村劳动力涌进城市，为我国的现代化建设作出了巨大的贡献，但是他们的孩子大多数只能留守在农村，形成了庞大的“留守儿童”群体。这是一个因独特的城乡二元经济社会结构和与之相联系的户籍制度而在我国经济社会发展过程中产生的一个特殊群体。由于种种原因，这一特殊的群体已成为违法犯罪高危人群，他们的犯罪呈现出低龄化、暴力性、团伙化、侵财性等特点。导致农村“留守儿童”犯罪增加的原因有很多，从外部环境分析，主要有家庭教育的缺失和弱化，学校教育的缺陷，社区功能弱化、疏于管教，社会环境的负面影响；从农村“留守儿童”自身的特点分析，主要是这些儿童辨别能力差，心理趋向不健康状态发展，存在不同程度的心理缺陷。应对农村“留守儿童”犯罪的问题，必须从家庭，学校，社会等方面出发，构建完善的教育机制，使农村“留守儿童”可以在良好的环境中健康成长，同时，也必须加强法制建设，构筑能保障农村“留守儿童”物质和文化需求的政策和一个良好的预防农村“留守儿童”犯罪的体系。

Research on the Crime Problems of Left-Behind Children in Rural Areas

Abstract

At present, with China's urbanization, marketization and rapid industrialization, More and more rural labor move into the city, as China's modernization made enormous contribution, but their children most can only stay in rural areas, forming a huge left-behind children groups.This is a special group, because of the presence of the rural-urban dual structure and the household registration system, so in the process of economic development have produced such a group.For a variety of reasons, this special group has become illegal crime high-risk groups, and their crime presents the low age change, violence, gangs, property intrusion characteristics.The rural left-behind children crime increased for many reasons, from external environment analysis, mainly is the family education, school education, community function has faults and social environment have negative influence.Rural left-behind children from the analysis of the characteristics of their own, mainly is these children recognize ability is poor, psychological development is bad, and have different degrees of mental defects.To solve the problem of rural left-behind children crime, must let family, school, society have the perfect education mechanism, make the rural left-behind children can live in the good environment, and at the same time, also must strengthen the legal system and establish the policy to guarantee their material and cultural needs and a good prevention crime system.
