行政复议的调解制度摘要:《中华人民共和国行政复议法实施条例》中引入行政复议调解制度是我国立法上的一次重大创新和突破。行政复议调解制度成为我国多元纠纷解决机制中的一种新的方法和手段，以现代行政理念为理论基石，由行政复议机关提供行政主体与行政相对人平等沟通交流协商的平台，促使公共利益与私人利益在沟通协调中寻求一种利益的平衡，以调解为手段最终实现纠纷的彻底解决，进而实现社会公共秩序与公民合法权益相统一。行政复议调解制度作为一种新的制度,在构建和谐社会的过程中,发挥着至关重要的作用。本文拟从分析我国行政复议调解制度的基本理论入手,进而阐述其在运行过程中的作用。但是,由于认识上的差异和经验上的不足,从既有的法律规范看,我国行政复议调解制度也还存在一定的缺陷。因此，本文就进一步完善的问题作讨论，最后提出完善我国行政复议调解制度的构想。
