我国民事惩罚性赔偿责任研究

摘要：惩罚性赔偿源于英美法系，该制度适应了当代世界经济社会发展的新形势，已为大陆法系国家引进吸收。近年来在我国的经济建设中也暴露出来了大量严重恶意民事违法行为，有必要借鉴英美法系国家惩罚性赔偿制度的设置，制定并完善相关立法。本文全面的讲述该制度的概念、历史演进及功能，深入分析我国相关立法中存在的问题以及制定并完善该制度的必要性，并根据以上考察研究，结合我国立法实践，借鉴英美法系国家成功经验，从扩大该制度具体适用范围，明确责任具体构成要件，确定赔偿数额的具体标准等几个方面提出了制定并完善我国立法的建议。

ABSTRACT:Punitive compensation originated in Anglo-American law,and this system is adaptive to the contemporary world economic and social development, so it has been civil law countries introducing absorption.In recent years in our country's economic construction also exposed a lot of serious civil illegal activities, and have malicious necessary sound. It is necessary to learn from countries of Anglo-American law system punitive compensation system Settings, to enact and perfect relevant legislation.This article tells of the system of comprehensive concept, historical evolution and function, in-depth analyses the problems existing in the relevant legislation and enact and perfect the system of necessity,and according to above study, with China's legislative practice,the successful experience from countries of Anglo-American law system,from expanding this system specific applicable scope, from ascertain responsibility specific constitutions, from determine the specific standard of compensation amount, etcproposes making and improve our legislation suggestion.
