建立环境责任强制保险制度的思考

当今社会，环境污染已经成为制约我国乃至全球经济社会发展的主要瓶颈。然而环境责任强制保险兼具了经济手段的弹性和行政手段的强制性，建立起符合实际情况的环境责任强制保险制度体系，对于解决环境污染问题，促进经济、社会、人类可持续发展都会有着重要的意义。本文从我国建立环境责任强制保险的必要性和可行性出发，指出了我国现行的环境责任保险所存在的问题及原因，并在借鉴国外相关制度的基础之上，对完善我国环境责任强制保险提出了建议与对策。

The research on the establishment of system of Compulsory Environmental Liability Insurance
Abstract: Nowadays, environment pollution has become a main bottleneck to constrain the development of economic of our country and even the whole world. However, mandatory environment liability insurance combines the elastic of economic means and the mandatory of administrative means．Based on our country’s real situation, the establishment of China’s environment mandatory liability insurance system is significant to solve environment pollution problems and to promote the development of economy, society and human’s sustain.This article from the establishment of China's environmental responsibility to enforce the necessity and feasibility of insurance, and points out that China's current environmental liability insurance have some problems,and the causes of those problems. Then related on the basis of the system of foreigners', this article puts forward the Suggestions and countermeasures to perfect our country environment compulsory insurance.
