论国家在反恐中的国际法责任
从二十世纪下半叶开始，愈演愈烈的国际恐怖主义严重影响和危害了世界和平与安全及人类的生存环境，已造成无数平民的牺牲及财产的重大损失。连续发生的恐怖主义活动一起国际社会的极大的震惊和强烈的反应，它已成为全人类的公害，进行行之有效的反恐怖主义实践已经刻不容缓。反恐怖主义的实践包含了很多值得研究的国际法问题，特别是国家责任问题。反恐中的国家责任问题包括国家责任的构成、内容、履行、免责事由等，这些问题需要得到清晰地阐述以便更好地指导实践。在反恐实践中我们应该明确什么是国家责任，以便更好地维护世界人民的整体利益，尤其需要注意研究哪些行为可以归于国家，“自卫”可否作为武力打击他国政府或未经许可，擅自攻击他国境内的恐怖分子行为的“免责事由”等。另外，由于国家主权的平等，各国之间没有管辖权，如何确保国家责任的履行，便具有非常重要的实践指导意义，这些问题非常重要，都亟需我们去深入地思考和研究。

Country Responsibility under International Law in Anti-terrorism
Abstract: From the second half of the twentieth century, the more and more intensified international terrorism seriously influenced and harmed the peace and security of the world and the living environment of the human beings. This also brought about a great number of sacrifices of civilians and heavy losses of properties. The continuously occurred terrorism caused tremendous shock and strong reaction of the international community and it has become the public hazard of all mankind. According to this, taking effective anti-terrorism practices is pressing now. These practices includes plenty questions of international law which are worth studying, especially questions of state responsibilities. The state responsibilities in anti-terrorism consist of the composition, content, perform and excuse for non-responsibilities which should be clearly represented in order to guide practice better. In the anti-terrorism practices, we should understand what is the state responsibility, so that we can protect the integral benefits for people in the world. We should particularly pay attention to the studying of what behaviors can be attributed to the States, if “self-defense” can be used as the “excuse for non-responsibilities” when military forces strike other governments or terrorists in other countries without permission. In addition, because of the equality of national sovereignties and there are no jurisdiction between countries, the question of how to ensure the fulfilling of state responsibilities has quite significant practical guiding meanings. All these are important and in urgent need of our thinking and studying.
