论国际法上的自决权

 民族自决权理论是马克思主义处理民族问题的一个基本原则,也是现代国际法体系中的支柱性基本原则.自诞生以来,对建立近现代民族国家,建立世界非殖民化过程以及奠定现代国际关系基础起了重要的作用.但是随着国际格局的变化,在当今的国际社会,民族自决原则本身就是个复杂的理论,加之其概念还不明确有很多模糊不清的地方,在这里我们着重分析了一下在当前形势下自决权遇到的一些问题如,被分裂分子滥用,成为分离主义的借口,极易被歪曲;自决权在当今世界潮流已过时等错误认识进行了探索和讨论,通过对自决权的正确认识和把握认识到自决权在当今世界所具有的重要的时代意义,从而更好地打击分裂主义,恐怖主义,维护国家主权和领土完整,为更好的解决国内问题提供法律依据,建立世界经济政治新秩序,促进世界和平发展.

Study on the Right of National Self-determination
Abstract:  The right to national self-determination theory is the theory of Marx to deal with national problems is one of the fundamental principles of modern international law, but also in the system of basic principles of pillar. But with the changes of the international system, in the international society, the principle of national self-determination in itself is a complex theory, and the concept is not clearly have a lot of ambiguities, here we focus on an analysis of the current situational of the right to self-determination in some of the problems encountered, For example, By the separatists abuse, become the separatist excuse, extremely easy to be distorted, The right to self-determination in the current world trend is outdated and incorrect understanding are explored and discussed, Based on self-determination of correctly understanding and grasping the knowledge of the right to self-determination in today’s world has the important significance of the times, In order to better fight against separatism, terrorism, safeguarding national sovereignty and territorial integrity, to better solve the problem of domestic provide a legal basis for the establishment of the new order of world politics, economy, promoting world peace and development.
