我国近十年的植物新品种保护制度取得了很大成效，但在立法、司法等各方面还存在着很多的缺陷和不足。审查期限漫长、司法取证困难等问题制约了植物新品种保护制度的实施，因此应在立法和和司法实践中采取各种措施，完善植物新品种保护制度的构建，提高育种者积极性，促进良种推广和农民增产增收。

Abstract: we have had great progress in the protection of plant variety in the past 10 years, but we also have many drawbacks in lejislative and judiciary. Implementation has been constrained by the long examing period and the transfer of evidence. So we should take various measures especilly In judiciary to perfect the system of plant variety protection. In doing this, we can improve the passion of the breeder and the promotion of good seeds and the improving of the production.
