法律英语词汇的特点及其翻译

本文从语言学的角度讨论法律英语的发展以及其词汇特点，有利于解决法律文件翻译中遇到的问题。法律英语在国际交流中起着愈加重要的作用；其专业性与庄重性要求人们谨慎地使用。本文主要研究和总结法律英语词汇的特点以便法律工作者更好地学习法律英语，从而更熟练地签订国际合同和保障法律文件翻译的质量。本文力图证明以下几点：学习法律英语必须同时学习好法律知识；学习法律英语词汇的特点这个艰巨的工作需要长期积累和分析；为了真实和准确地表达法律文件的内容，法律工作者要考虑到语言功能和法律功能的对等性；法律英语和普通英语的区别、不同法律术语的意思、法律英语中一词多义的情况是法律英语研究中必须注意的三个问题。

Abstract
This paper, from the perspective of linguistics, first discusses the development and the characteristics of legal English vocabulary, and then pays attention to the translation of legal English vocabulary through analyzing the concerned wrong cases. Legal English plays an important role in international communication, and it is professional and its formality requires cautious usage. The characteristics of its vocabulary are probed to help legal professionals to get a better command of legal English, so that they can sign agreement with foreigners without language problems and to guarantee the quality of legal document translation. The discussion has revealed that the learning of Legal English can not be divorced from the study of law knowledge as well as linguistic knowledge, that the study of legal English vocabulary characteristics is a laborious job that needs permanent accumulation and analysis, that in order to express the authentic meaning of the legal document, legal professionals should consider equality of both linguistic function and legal function, and that attention should be paid to the difference between legal English and common English, to the meaning of different legal terms and to the condition of several translations for one word.
