从“301条款”看美国单边主义及我国的对策

美国贸易法“301条款”是美国国际贸易法的重要组成部分，也是美国单边主义行径的最具代表性的法律，它的产生和发展对维护美国国家经济利益起着重要的作用。随着我国对美贸易摩擦的不断升温，美国政府动辄以301条款来威胁我国。本文首先介绍了美国“301条款”的主要内容和美国单边主义的由来；紧接着，通过对“301条款”的分析来揭示美国单边主义的倾向；之后结合“301条款”对我国的调查来总结301条款对我国产生的影响；最后，根据我国国情提出切实可行的应对“301条款”的对策和制约美国单边主义的建议。

An Analysis on American Unilateralism based on "Section 301" and Our Countermeasures

Abstract

     Section 301 of U.S. trade law is an important part of trade law in United States, and is the most representative of legal act of U.S. unilateralism. Its emergence and development plays an important role in the maintenance of U.S. national economic interests. With the increasing trade friction between China and U.S., the U.S. government frequently threat China with the "Section 301". This paper firstly introduces the origin of the "Section 301" and U.S. Unilateralism. Second, this paper reveals the tendency of U.S. Unilateralism through the analysis of the "Section 301", and then analyzes the influences of "Section 301"on China. Finally, offers some countermeasures to resist "Section 301" and to restrict American unilateralism.
