从模因理论看商务合同固定条款的翻译

    在经济全球化的环境下,不同国家间合法有效的交际已成为当务之急。在中国，商务合同翻译不太令人满意。因为缺乏专业的翻译者导致了许多双方当事人之间的纠纷。模因论是以达尔文的进化论为基础，解释文化现象的进化。本文试图从模因论的视角找出相应的翻译策略为分析商务合同的翻译条款提供启示。首先，作者简要介绍选择模因论的原因，以及对模因论进行简单的介绍，包括模因的概念，发展历史，人类的模仿和模因的复制，成功模因的三个性质。然后，作者试从商务合同的概念，分类以及文体特征等方面进行分析，并且分析了模因论在商务合同固定条款中的应用。最后作者指出主要观点并且总结全文。

Abstract
Under the circumstance of economic globalization, the demand for effective legal communication among different countries has become urgent. However, the fact is that in China, the translation of business contracts is far from satisfactory, which causes a large number of disputes and negotiations between two parties involved due to the lack expertise of translators. Memetics is a theory based on Darwin’s theory of evolution, explaining the law of cultural evolution. The paper is intended to analyze translation of set clauses in business contracts from the perspective of memetics to find out correspondent translation strategies. Firstly, the author makes a introduction of the reason why the author choose the Memetics Theory and a introduction to Memetics, which include definition of the concept Meme and its developing history, Human’s imitation and meme replication and the three qualities of a successful meme. Then, the author tries to analyze definition, classification and stylistic of business contracts and the application of Memetics theory in set clauses of business contracts translation. Finally, it is a conclusion that highlights the major aspects of the whole thesis.
