论司法不作为的表现、成因及相对人的救济途径
近年来政府各部门屡次被爆出行政不作为的状况引起了社会的广泛关注，使得社会各界对“行政不作为”都保持较高的关注度。而司法领域的“司法不作为”却鲜有人提及，这是说司法不作为现象不存在或者存在较少吗？恰恰相反，近年来我国司法领域的司法不作为现象层出不穷。目前我国司法不作为主要表现为司法部门不能按照法律规定对当事人的请求予以支持，致使法律程序无法正常启动和司法程序中司法人员未能依照法定程序办事导致司法不公正时有出现。司法不作为出现的原因既有司法制度设置不完善的因素也有司法部门人员结构复杂、专业素养低的因素还有对司法不作为的监督与处罚力度不够的因素。针对司法不作为的治理和相对人的救济问题，笔者认为应当背靠当下司法改革的热潮，各部门积极行动，从司法制度设置到司法人员的选拔与考核再到对相对人救济的具体操作等问题入手解决，以此彻底解决我国现存的司法不作为现象。

ABSTRACT: In recent years, some departments of the government have repeatedly been accused of "Administrative Inaction", which attracted considerable attention from the whole society. In view of the administration of justice and the relief of relative people, I believe that we should rely on the current judicial reform of the upsurge of various departments to actively action, from the judicial system to the selection and assessment of the judiciary and then to the relative relief of specific operations Problem to solve, in order to completely solve our existing judicial misconduct.
