论《吴中判牍》的审判艺术

本文旨在通过研究《吴中判牍》中的具体个案，按照现代案件分类方法分类其中的案件类型并进行表格统计，在此基础上对各种类型的具体个案进行分析，形象地为大家展示其中的审判制度与技巧。通过对《吴中判牍》中案件的研究可以让大家对清代基层官员如何处理各类案件有个清晰的认识，进而反思其中的优劣，可以对现今案件审判制度起到启发的作用。
本文共分为四个部分。第一部分为绪论，主要内容是本文研究的目的、研究所采用的方法和研究的对象，其中研究对象方面会对作者以及本书的写作背景进行概述；第二部分为案例类型分析，其中会采用表格统计的方法，将书中案件分为民事、刑事、行政三大类，其中会重点对民事类细分出婚姻纠纷、家庭家族纠纷（主要是继承或财产侵占）、债务纠纷、土地纠纷四类；第三部分内容为分析《吴中判牍》中各类型案件的审判艺术，在第二部分案件分类的基础上在同类案件中进行对比以得出其中的特色；本文最后部分为总结，将对《吴中判牍》中审判特征和意义进行归纳，并作出延伸。

Discussion the Art of Trial in Wu Zhong Pan Du
 
Abstract

This paper aims to study the case in Wu Zhong Pan Du, put the case classification and making statistical tables. Then I analyze the various types of cases in order to show the trial system in this book to you. Through the study of this book, we can understand the Qing Dynasty’s officials how to deal with all kinds of cases and promote the development of today’s trial system.
This paper is divided into four parts. The first part is introduction, I introduce the study purpose, research method and subject investigated. The second part is case analysis. In the third part, I will analyze the specific cases in Wu Zhong Pan Du. The last part is conclusion, I make a summary of this paper and supplementary some contents.
