论我国刑事诉讼中非法证据排除规则的运行

新刑事诉讼法初步确立了我国的非法证据排除规则，其主要包括强制性排除、自由裁量排除及可补正的排除。通过对非法证据排除规则在侦查、审查起诉、审判不同阶段的运行情况的了解，可以发现其在司法实务中存在着一系列的问题，我们必须针对这些问题去制定的相应对策，以保障现有的规则能够在司法实践中得以良好实施。

The Operational Of Exclusionary Rule In Criminal Proceedings
ABSTRACT：The new Code of Criminal Procedure built up the exclusionary rule for the first time. It’s main including mandatory exclusion, discretion and may exclude compensation exclusion. We can find many problems through the exclusionary rule operate in the investigation, prosecution, trial. So we must find some countermeasure to deal with these problems to safeguard the rule can be achieved in judicial practice.
