论我国人民陪审员制度的完善

我国人民陪审员制度是一项法律规定的基本审判制度，它对于提高诉讼效率、节约司法资源、提高公民参与法律活动的意识具有重要意义。从我国国情出发，人民陪审员制度存在立法现状和司法现状两个方面的问题，导致人民陪审员制度现状的原因，包括立法中存在规定适用人民陪审员的案件范围较模糊、选任条件限制较多等问题；司法中存在对法院和人民陪审员缺乏制约机制、审判员和人民陪审员缺乏默契配合等问题。针对以上问题，从恢复其在宪法中的地位、人民陪审员选任制度的完善、转变思想和提高素质等方面对该制度予以完善。

Study on the Perfection of the People’s Jury System         of Our Country
ABSTRACT：The People’s Jury System of our country is a basic judicial system stated by law . It is significant for improving lawsuit efficiency, economizing judicial resources, and improving the consciousness of participating in law activities of citizens. The problems that exist in The People’s Jury System are legislative and judicial issues. The current situations of legislative aspect of The People’s Jury System are caused by vague range of application of the system and a large number of limitations of qualifications, etc. The main reasons leading to current situations of judicial aspect of the system are lack of restraint mechanisms for the court and the people’s jurors; a tacit understanding between the judges and the people’ jurors, etc. The thesis emphasizes the perfection of the People’s Jury System of our nation by restoring to its rightful position in constitution, perfecting selection system, changing perception and improving quality.
