试论宪法视野下的法律监督权监督制度是国家制度的重要组成部分，通过权力分离实施相互制约是法律监督权的体现，其具有实质合理性和正当性，这可以实现自由与秩序的动态平衡，对于保障司法公正具有重要意义，可防止和减少违法行为。宪法监督是总体的法律体系，其目的在于维护宪法和树立其威望，保证宪法的落实执行和保障公民的权利和自由。依靠法律引导和规范监督行为,依靠法律明确监督者与被监督者的权利义务关系,从而增强监督的权威性、严肃性。各级机关通过形成一个"上下统一"的有机的整体从而增强法律监督合力，法律监督权是使权力依法行使,扼制特权、避免独断专行和滥用、误用权力的重要保障。“限制公权、保障私权；公权力必须受到遏制和约束”是既符合权力监督又符合法治要义的观点。在推进依法治国政策的同时，法治观念逐渐家喻户晓，人民群众的权利意识也不断上升，法律监督变得尤为重要，进一步完善规范监督制度和程序是必要的、紧迫的。因此推动法治进程以及构建社会主义和谐社会对于完善我国的法律监督制度举足轻重，要形成“严密的法律监督体系”，完善法律监督，加强法律实施。
