论网络犯罪的刑法应对

随着信息技术的飞速发展，网络犯罪案件层出不穷，呈现出复杂性、犯罪方法新型、多样、危害大等的特点。为了有效的打击网络犯罪，刑法285、286、287条对其进行了规制，此后又出台了《刑法修正案》（九）增设相关的罪名，例如拒不履行信息网络安全管理义务罪、非法利用信息网络罪、帮助信息网络犯罪活动罪，增加了对单位实施网络犯罪的相关规定。面对频发的网络犯罪案件，我国刑法还是存在着相关罪名较少、量刑低、刑种不够丰富的问题。为有效的解决这些问题，一方面我国刑法应该增设相关的网络犯罪罪名，区别于传统犯罪的罪名，另一方面加大对网络犯罪的惩处力度，增设附加刑没收财产，非刑罚处罚方式。

ABSTRACT: Along with the rapid development of information technology, network crime cases emerge endlessly, showing complexity, new methods of crime, variety and great harm. In order to effectively combat network crime, the criminal law 285, 286 and 287 have been regulated. After that, the criminal law amendment (nine) has been set up to add related charges, such as refusing to carry out the crime of information network security management obligation, illegal use of information network crime, and helping the information network crime, and increase the unit reality. The relevant provisions of the application of network crime. In the face of frequent crime cases, there are still some problems in our criminal law, such as relatively low number of charges, low sentencing and insufficient punishment. In order to solve these problems effectively, on the one hand, the criminal law should add the related crime of network crime, distinguishing the crime of traditional crime, on the other hand, increase the punishment to network crime,such as add additional penalty confiscated property and non penalty punishment.
