“网约车”的法律风险研究

网约车是互联网经济快速发展的产物。网约车能够使人们的出行更加的便捷、经济。但是网约车在其运营发展的过程中也暴露出了很多的问题。消费者在使用网约车的过程中面临着个人安全和隐私泄露的法律风险。预防这一系列的法律风险，我们必须对网约车平台的法律地位加以明确。在发生法律纠纷时不能一概而论，要根据网约车平台与驾驶员之间的不同关系来具体划分平台公司与驾驶员之间的责任。在此基础之上，还要对网约车可能出现的法律风险拟定出具体的预防措施，来防范法律风险，保护消费者合法权益。

Abstract : Network car is the product of the development of the internet economy. It can make people travel more convenient and economical. But it can also revealed many problems in the process of its operations. Consumers are faced with personal safety and privacy disclosure when they use the network car. To prevent this series of legal risks, we must make clear the legal status of the Network car. It can’t be generalized when the legal dispute occurred, according to the different relationships between the network car platform and the driver the duties should be specifically divided. On this basis, it is necessary to formulate specific preventive measures for the legal risks that may occur on the Internet so that it can prevent legal risks and protect the legitimate rights of consumers.
