企业字号中所涉及的商标权问题研究

企业字号是企业名称中的核心要素，也是企业名称中最显著和最重要的组成部分，代表了企业的实力与信誉。然而，正是因为字号具有极高的辨识度，往往成为被侵权的对象。目前常见的字号侵权形式主要是字号与商标权的冲突。企业字号有别于商标权，有其特定的内容构成、适用范围和取得方式。企业字号中有关商标权的问题主要是企业字号被侵权后的法律认定、在先字号与在后商标权的冲突以及字号与字号的冲突等。我国现有法律保护机制存在的主要问题是：企业字号的权利主体不够全面、内容和范围不够丰富、侵害行为认定不够清晰以及救济途径不够有力等。因此在完善我国企业字号相关法律制度的同时应提高企业自身的权利维护意识。

The Study of Enterprise Names Related to Trademark Rights

Abstract: The name of enterprise is the core element in the name right of the enterprise, and it is also the most significant and important part of the company name’s right. The name of enterprise represents the strength and reputation of the company. However, because of the high degree of recognition of the name of enterprise, it is often the object of infringement. At present, the common type of infringement is mainly the conflict between the name right of enterprise and the trademark right. The company name is different from the trademark right. It has specific content composition, scope of application and method of acquisition. The issues concerning trademark rights in the company's name are mainly the legal determination of the infringement of the company's name, the conflict between the prior to the name of enterprise and the trademark rights, and the conflict between the font size and the name of enterprise. The main problems of the name of enterprise existing in China's existing legal protection mechanisms are: the fullness of the subject matter of the right of the name of enterprise, insufficient of content and scope, incomplete identification of infringement acts, and strength of remedial approaches. Therefore, while improving the legal system related to the name of enterprise, we should also raise the awareness of the Self-protection rights awareness of enterprise.
