电子数据证据的运用规则研究

新修订的《民事诉讼法》、《刑事诉讼法》及的《行政诉讼法》都将电子数据证据作为一种法定的证据种类而予以制约和规范。这对于我国的司法制度来说，是证据制度迈出的重要一步。但该规定结合当前的司法实践的具体运用来看，是存在不足之处的。目前关于电子数据制度的具体规定还没有立法上的统一规定，主要散见于各司法解释、部门规章、地方性法律法规等。立法上的缺失性导致在司法实践运用中的局限性，而电子数据证据制度的出发点是对运用规则进行研究，对运用规则在实践中的具体操作的探究，会展现当前我国在司法实践中运用方面的不足之处，对取证、认定、保全等环节上存在的问题进行深入细致的探究是研究运用规则最重要的环节。因此，针对目前我国司法实践的现状，结合对电子数据证据的具体运用规则的研究，重点是对各环节存在问题提出与之相适应的对策举措，这样可以有效的保障各诉讼主体的民事权利，使得电子数据证据制度更加的完善。

Research on the Rules of Electronic Data Evidence

Abstract: The newly revised laws including Civil Procedure Law, Criminal Procedure Law and Administrative Procedure Law all restrict and regulate electronic data as a legal type of evidence. This is a significant progress for evidence system in the history of reform of the judicial system. However, in view of the specific judicial practice, there are many shortcomings. At present, the specific regulations on the electronic data system do not yet have uniform regulations. They are mainly found in judicial interpretations, departmental regulations, and local laws and regulations. The lack of legislation leads to the limitations for the use of judicial practice. The use of rules is the first step for the study of electronic data evidence systems. According to the study of application rules in practice, we will find problems in the application of judicial practice. The in-depth exploration of problems in the process of evidence collection, identification, and preservation is the most important part of the study of the rules of application. Therefore, in view of the current status of judicial practice in China and combined with the study of the rules for the specific use of electronic data evidence. The key point is to propose solutions for the existing problems. Only this way can effectively protect the civil rights of all litigation subjects and promote electronic data evidence related system further development
