试论述我国的公共秩序保留制度

近几年来我国涉外案件不断增多，国际私法的运用也越来越频繁。公共秩序实质上是一个抽象的概念，是一个国家内在生成的规则集合体，带有强烈的国家保护色彩。公共秩序保留制度是公共秩序经过演化所形成的，它的主要作用就是为了保障法院地国的公共秩序不被侵犯，合理运用这项制度，能够使违反内国基本公共秩序的外国法律无法适用，最终使内国的公共利益得到保障。本文主要通过对我国公共秩序保留制度的立法、实践状况进行研究，从中总结出存在的现实问题，对这些问题提出具体的解决方法，以提高我国在处理涉外法律冲突中的能力。

Try to discuss the system of the reservation of public order in China
ABSTRACT: In the sale of commercial housing, the current law of China has made relevant provisions on the compensation liability of the developer of the sale contract, but it still manifests its shortcomings in the practical application. On the basis of the research results, the article starts with the application of the compensation liability of the developer in the commercial housing contract, and gives the perfect suggestions from the angle of protecting the buyer's interests so that the buyer can effectively safeguard the rights of the buyer according to law.
